RPM Power Terms & Conditions

If you make a purchase through any of the RPM Power websites, in the RPM Power Store or over the phone/via email with an RPM Power team member, then you are accepting the terms and conditions outlined below.

Payment:

  • RPM Power reserves the right to dispute any chargeback or payment reversal claim where goods have been delivered or services have been provided in accordance with these Terms and Conditions.

Pricing:  

  • At RPM Power, we strive to ensure that all product prices displayed on our website are accurate. However, errors may occasionally occur. If an item is listed at an incorrect price due to a typographical error, a mistake in pricing information received from our suppliers or a technical issue, we reserve the right to cancel any orders placed for that item at the incorrect price. In such cases, we will notify the customer as soon as possible and provide the option to either proceed with the order at the correct price or receive a full refund. RPM Power is not obligated to honour purchases made at an incorrect price.
  • Our product prices may change due to regular promotions, sales campaigns, stock availability or other factors. If you purchase a product and the price is later reduced, we are unable to offer a refund, price adjustment or credit for the difference.
  • All purchases are made at the price displayed at the time of checkout, and we do not retroactively apply discounts or promotions to past orders. We run regular and seasonal sales and encourage customers to take advantage of our special offers when available.

 


Pre-Orders:   

  • Pre-order products are sold based on estimated arrival dates only. These dates are provided by manufacturers, suppliers and freight partners and are subject to change without notice. RPM Power does not guarantee pre-order arrival dates and accepts no liability for delays outside of its reasonable control. Customers may cancel a pre-order for a full refund at any time prior to dispatch.
  • Although RPM Power may notify customers of pre-order delays via email, the company is under no obligation to do so and we encourage customers to regularly review the product listing for most recent estimated arrival dates for pre-orders

Order Fulfilment & Dispatch:   

  • Although we try to accurately reflect all product details on the product information page, some information may differ. RPM Power reserves the right to make minor changes to product specifications, packaging, colours, components or features where such changes do not materially affect the product's intended performance or functionality.
  • Although we try to maintain accurate product stock levels, it can be the case where a product is purchased that is out of stock or has been set as available on our website in error. In cases such as this, RPM Power will contact the customer directly and offer either a full refund for the unavailable item charged or a similar, alternative product option.
  • Shipping fees charged are based on the weight and size of product purchased. RPM Power reserve the right to charge customers shipping fees based on order criteria met. Orders will be dispatched via tracked courier or via the pallet network. For more information on shipping processes, visit our shipping and delivery page. 
  • RPM Power reserve the right to cancel and refund any orders placed for delivery where shipping costs are discovered to be significantly higher than standard rates. Should a customer request delivery regardless of the increased cost, the customer will be asked to incur the additional fee. RPM Power reserve the right to determine what level of increase in standard shipping rates constitutes the need to cancel and refund orders.
  • RPM Power will not hold stock for any orders. In rare circumstances, however, and if agreed in advance, we may hold an order for a maximum of two weeks without guarantee. RPM Power reserves the right to cancel and refund any orders held beyond this period, regardless of whether payment has been made. 

 


Order Shipping, Delivery & Collection:   

  • RPM Power works with third-party couriers and fright companies to deliver orders to customers. These parties are external to RPM Power. Although we will try our very best to assist our customers if they have any queries on the status of delivery with third-party couriers, RPM Power ultimately has no control over the process of delivery and is not liable for any actions carried out by staff members associated with these companies.
  • Any delivery dates or delivery timeframes provided by RPM Power are estimates only and should not be considered guaranteed delivery dates. Delays may occur due to factors outside of our control.
  • Customers are encouraged to inspect all products upon delivery and notify RPM Power of any visible damage, missing parts or delivery discrepancies within 48 hours of receipt. Failure to report issues within this timeframe may affect our ability to investigate and resolve claims with the carrier.
  • Where a customer refuses delivery of a non-faulty item, RPM Power reserves the right to deduct any shipping, return shipping, storage and handling charges incurred from any refund issued.
  • Customers are responsible for ensuring that all delivery addresses, contact details, and order information provided at the time of purchase are accurate. Any additional costs incurred due to incorrect information may be charged to the customer.

 


Installation Services:   

  • Install dates will not be confirmed or scheduled until payment has been received in full. Payment must be received by RPM Power at least two weeks in advance of a scheduled installation date.
  • Upon RPM Power’s completion of equipment installation, an inspection will be conducted to ensure proper functionality of the equipment. Customers are expected to confirm satisfaction with the installation via the form provided by one of our team members on-site. 
  • It is RPM Power’s strong recommendation that all gym equipment be installed on the ground floor. Should the customer request an install and/or self-assemble on another floor level, RPM Power suggests that a structural engineer is consulted prior to the installation – this is the responsibility of the customer. RPM Power does not accept any liability for structural implications and/or damages that are caused by the installation of equipment on any floor above ground level.
  • Should a customer require additional assistance after the installation/delivery process has been completed, a call-out fee will be applicable based on the task required and location.

Customer Support Services:

  • We do our very best to ensure all information provided by our Customer Support, Sales and Repairs Support Teams is as accurate as possible. The information provided by our chatbot, Rachel, is for general informational purposes only. While we strive to ensure accuracy with this chatbot, we cannot guarantee that all content it provides is complete, current or error-free. We are not liable for any inaccuracies, misrepresentations or reliance on information provided by this bot and encourage our customers to verify any information before acting on it, including product purchasing.
  • Should a customer require additional assistance from RPM Power’s installation team when self-assembling a product, a phone call/ video call will be arranged as an initial step. If necessary, a call out may be required. In such circumstances, a fee will be applicable and is determined by the task at hand and location of the customer (call-out only). In cases where a manufacturing fault is discovered with the product, this fee will be refunded to the customer. 


 

Product Warranty and Repairs:   

  • RPM Power offers a back-to-base warranty on all products. The warranty coverage varies for products available to purchase from RPM Power. Please check the warranty coverage for product you wish to purchase as well as full terms and conditions in our warranty section.
  • Using non-commercial-graded products (i.e. home-use equipment*) in commercial settings will result in a null and void warranty.
  • Modifying items without consulting RPM Power in advance will null and void the product warranty.
  • RPM Power does not accept returns, exchanges or warranty claims for products purchased through third parties or private sales; all aftersales support is strictly limited to the original purchaser with proof of purchase from RPM Power or an authorised retailer.
  • Ongoing maintenance services are not provided by RPM Power. Customers are responsible for scheduling and performing regular maintenance checks to ensure equipment performance and longevity. Recommended product maintenance guidelines are outlined in product manuals and on our website. We also offer equipment servicing at a cost.
  • RPM Power has the right to refuse warranty claims for equipment damages or malfunctions due to lack of customer maintenance and/or due care. Furthermore, RPM Power has the right to determine what constitutes acceptable** due care, and whether this has been met or not. This is based on a visual inspection by a member of our team.  
  • Should an item require repair and a lack of due care and/or maintenance is evident, a repair fee will apply based on the task required.  
  • In the event that a product is delivered with a missing part, component, accessory, or hardware item (including but not limited to bolts, screws, washers, pins, or fittings), RPM Power must be provided with a reasonable opportunity to investigate the issue and source a replacement. RPM Power shall not be liable for any costs incurred by the customer in purchasing replacement parts or components unless the customer has received prior written authorisation from an authorised RPM Power representative instructing them to do so. RPM Power reserves the right to determine the most appropriate resolution in cases such as this, including but not limited to supplying replacement parts, arranging delivery of missing items, providing technical assistance or offering an alternative remedy where deemed appropriate.
  • RPM Power reserves the right to refuse warranty claims in circumstances where slight cosmetic blemishes are apparent on a product. The cosmetic blemishes in question should not compromise the functionality of the product. RPM Power cannot offer compensation and/or exchanges for items that show any signs of slight scratches, marks, or other light cosmetic damages. RPM Power retains the right to determine what constitutes light cosmetic damage on a product.
  • Standard warranties will not apply to any item marked as clearance and/or ex display models. RPM Power are, further, not liable to accept returns and to grant refunds for any items marked as clearance and/or ex display.

  • While RPM Power endeavours to support its products for as long as reasonably possible, we cannot guarantee the ongoing availability of spare parts for discontinued products.

*The distinction between ‘home use’ and ‘commercial use’ products is generally outlined in the product specification section of each individual product and/or is evident from the category page in which the product in question can be found as well as the name of the product (Essential, Pro, Elite). This distinction is also covered on our warranty section.

**Unacceptable levels of care include, but are not limited to product rusting, visible prolonged uncleanliness, overloading on product maximum capacities, disregard for product specifications, overuse on replaceable parts (e.g. cables) and improper maintenance. 

 


Product Returns:  

  • Returns or exchanges are accepted within 30 days of product receipt, provided the item remains unused, in its original packaging and is in good merchantable condition. RPM Power holds the right to determine if a product is in good merchantable quality based on a product inspection. Products returned to RPM Power that do not meet this criteria can be sent back to the customer for a shipping fee.
  • RPM Power reserve the right not to accept returns where items are not in their original packaging. Should RPM Power, at their discretion, accept a return where products are not in their original packaging, the item(s) will be considered second-hand quality and a deduction of 25-30% will be applied per item to reflect the resalable value.
  • Return shipping costs are the responsibility of the customer. Should RPM Power arrange a collection on the customers behalf, this cost will be deducted from any refunds issued. 
  • RPM Power encourages customers to send all return products via tracked courier to ensure they do not go missing in transit. RPM Power is not responsible for any returned items that do not arrive at the RPM Power offices.

Cancelling an Order: 

  • If your order has not yet been dispatched, you can cancel it and receive a full refund. This is under the condition that you notify us as soon as possible to ensure we can prevent the order from leaving our warehouse. 
  • If your order has not yet been dispatched but has not yet been delivered, in most cases you can still cancel your order and receive a refund less the shipping cost. Here we will try to get in touch with the courier directly ourselves, however, it may be the case that you will have to refuse the order on delivery.

Liability:   

  • RPM Power bears no liability for injuries or damages that occur as a result of using our fitness equipment. Customers are urged to adhere to instruction manuals, manufacturer guidelines and to seek guidance where necessary.   
  • RPM Power further disclaims liability for any injuries that may occur during the equipment installation process where applicable. 
  • RPM Power assumes no liability for equipment damages or malfunctions due to lack of customer maintenance and/or due care.
  • It is the responsibility of the customer/user to ensure they are aware of how to correctly and safely use a product before attempting to exercise or engage with it in any way. RPM Power is not liable for injuries or damages that occur to the user, other people, animals or objects in the surrounding environment (including the environment itself) as a result of improper or unsafe use of the equipment. All users should ensure they are properly informed of how to correctly and safely perform any exercise or activity they undertake with RPM Power equipment.
  • RPM Power shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, severe weather, strikes, labour disputes, supplier failures, transportation disruptions, customs delays, pandemics, acts of government, war, civil unrest, or other unforeseen events.

 


Terms and Conditions:  

  • RPM Power reserves the right to amend these terms and conditions at any time, and it is the responsibility of the customer to stay updated.  
  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the Irish courts.

 

 

Intellectual Property Notice

  • All product images, graphics, videos, and other creative content displayed by RPM Power on owned websites, third-party retailer websites, social media channels, printed media and other domains are the sole property of RPM Power and are protected under applicable copyright and trademark laws. Unauthorised use, reproduction, modification, or distribution of our images, including the addition of third-party logos or branding, constitutes an infringement of our intellectual property rights. Any misuse of our protected content, including but not limited to the unauthorized display of our registered logo, will be treated as a violation of our legal rights and may result in immediate legal action.
